Who Can File A Wrongful Death Claim In Texas, And How Long Do They Have?

Surviving family members can file a wrongful death claim in Texas. This includes spouses, biological and adopted children, or parents.

The statute of limitations for filing a wrongful death claim is just two years from the date of the death. There are exceptions for certain situations, such as the person making the claim is a minor or the claimant suffers from a physical or mental condition that prevents them from filing. If there were actions by the negligent party to hide information pertaining to the death, the family may have more time as well.

In most cases, you are better off starting the claim as soon as you are able. It will be easier to collect evidence and build a strong case for damages if we get started early.

Damages That You May Recover After A Wrongful Death

The damages people receive in a wrongful death suit typically include compensation for economic damages and noneconomic damages.

Economic Damages

These may include compensation for:
